GrowthFoundation.in imparts online video-based as well as live tutoring and certifications through its education portal. These Terms of Use govern the usage of GrowthFoundation.in and Services thereof. Using or browsing the GrowthFoundation.in website means that you have accepted these ‘Terms of Use’. Don’t use or browse the GrowthFoundation.in website if you do not agree to any or all of these ‘Terms of Use’. ‘You’ here means not only the student who is using the service, but also the parent or adult who is paying for the service. GrowthFoundation.in hereby grants you a personal, non-transferable and terminable right to access its website and courses GrowthFoundation.in subjectto the following terms and conditions.

How it works

Registration
If you intend to use the GrowthFoundation.in Services, you need to register on the site and pay the applicable fee. You will be given a username, along with the password.
When you register with GrowthFoundation.in, you agree
• that you will provide current and complete information about yourself as per the requirements of registration (“Your Data”)
• that you will maintain and update Your Data to keep it current and complete
• that you will use the courses, services, tests and learning sessions only for your personal use, and would not allow unauthorized access to anyone else
• that you will not use the site, the Services or the Content for any unrelated business or non-business purpose
• you must notify GrowthFoundation.in immediately, as and when you become aware of any breach of security or unauthorized use of your GrowthFoundation.in account.

Taking Courses
You can view thenumber of video lectures, assignments etc assigned to the course you purchased. If the specific course restricts number of streaming of a video, you shall only be able to each video only for such specific number of times. Live lectures, if any, will be scheduled by GrowthFoundation.in and notified to you. However, GrowthFoundation.in may, at its sole discretion, be constrained to restrict peak hour usage.

Taking Tests
You can take each test available on the website GrowthFoundation.in only as often as permitted by the course instructor, any time during the validity of the subscription. Exceptions to this will be specified by the course instructor. In rare cases, GrowthFoundation.in may allow you to take a test again. All such cases may be restricted to technological or other unforeseen circumstances, solely to be considered by the management.

Hours of availability
GrowthFoundation.in provides 24/7 services. However, you may not always be able to view a lecture or take a test due to technology problems, or during periods of site maintenance.

Technology
While GrowthFoundation.in makes all efforts to ensure stability and availability of technologies used, the company does not hold out any guarantee in this regard. You will be solely responsible for access to and use of GrowthFoundation.in Services and upkeep of all hardware and systems required for such access and use.

Content
You will access and use GrowthFoundation.in only for lawful purposes. Knowledge of and adherence to all rules and regulations pertaining to your use of GrowthFoundation.in, will be your sole responsibility.

Opportunities
You may avail job opportunities by the affiliates or by cross-references by your peer group in the course. However, GrowthFoundation.in does not hold any responsibility for changes in the job profile, salary, location etc offered by the affiliate companies. Such terms will solely be negotiated directly with the affiliate companies. Also, while we try to have concrete agreements with the partnering companies, the courses do not guarantee job opportunities and the offer could be affected owing to any changes in the company’s requirements during the course.
By accessing GrowthFoundation.in you agree that you will not:
• use GrowthFoundation.in to violate any local, state, Federal or international law or regulation;
• post or transmit any unlawful, or otherwise objectionable Content;
• alter, damage or delete GrowthFoundation.in Content or communications;
• disrupt the normal flow of communication in any manner, whatsoever, or otherwise interfere with the ability of others to access GrowthFoundation.in;
• post or transmit any advertising or promotional materials to other users;
• infringe any intellectual property rights, publicity rights or privacy rights;
• otherwise create any liability on behalf of GrowthFoundation.in.

Pricing
Pricing is subject to change. GrowthFoundation.in reserves the right to change the pricing without advance notice.

Cancellation & Refund
Subscription to GrowthFoundation.in services can only be cancelled if it has been made by human mistake. To cancel the subscription and claim full refund, the customer should immediately notify GrowthFoundation.in via email and phone of the error thus made. Also note that such notification must reach the concerned person before the log-in details and/or study material are mailed by GrowthFoundation.in. Once the email with log-in details and/or courier of the study material is dispatched by GrowthFoundation.in, request for cancellation and refund would be governed by the following clause on ‘Termination’.

Termination
If you are in any way dissatisfied with GrowthFoundation.in or with its Services or Content, you have a right to discontinue accessing GrowthFoundation.in. All courses have a 100% refund policy up to 14 days after payment or half the course duration, whichever is lesser. However, once you receive a refund for a GrowthFoundation.in product, you cannot buy and reclaim refund for the same product or any product on the website for up to 12 months.

GrowthFoundation.in, in its goodwill, may choose to refund part of your fees outside of this time bracket. Any such refund will be on sole discretion of the management of GrowthFoundation.in. If, on the other hand, GrowthFoundation.in believes that your conduct is in violation of this Agreement or is otherwise harmful to other users, GrowthFoundation.in, in its sole discretion, may terminate or temporarily suspend, without notice, your access to our programs. You may not have any right of refund under such circumstances.

Indemnity
You agree to defend, indemnify and hold GrowthFoundation.in harmless from and against any and all claims, damages, obligations, losses, liabilities arising from:
• your use of and access to the GrowthFoundation.in Website;
• your violation of any term of these Terms of Use;
• your violation of any third party right, including, without limitation, any copyright, property, or privacy right; This defense and indemnification obligation will survive these Terms of Use and your use of the GrowthFoundation.in Website

Privacy
Any information submitted on the GrowthFoundation.in website is subject to our Privacy Policy, which can be viewed at https://growthfoundation.in/privacy-policy/.

General Legal Terms
The Terms constitute the whole legal agreement between you and GrowthFoundation.in and govern your use of the Services and completely replace any prior agreements between you and GrowthFoundation.in in relation to the Services. You agree that if GrowthFoundation.in does not exercise or enforce any legal right or remedy which is contained in the Terms (or which GrowthFoundation.in has the benefit of under any applicable law), this will not be taken to be a formal waiver of GrowthFoundation.in rights and that those rights or remedies will still be available to GrowthFoundation.in. These Terms shall inure to our benefit and to the benefit of our affiliates, licensees, successors, and assigns. If any provision of these Terms is found to be illegal or unenforceable, these Terms will be deemed curtailed to the extent necessary to make the Terms legal and enforceable and will remain, as modified, in full force and effect.

The Terms, and your relationship with GrowthFoundation.in under the Terms, shall be governed by Indian laws; exclusive place of jurisdiction shall be Ahmedabad, Gujarat. All disputes or differences whatsoever arising between You and GrowthFoundation.in hereto out of or relating to the construction, meaning and operation or effect of this Agreement or the breach thereof, which cannot be settled by mutual discussion, shall be settled by arbitration in accordance with the Rules of Arbitration of the Indian Council of Arbitration and the Award made in pursuance thereof shall be binding on the parties.
Any notices required or permitted by this Agreement shall be deemed given if sent by certified mail, postage prepaid, return receipt requested or by recognized overnight delivery service to: 4, Ankur society-2, Naranpura, Ahmedabad 380013.

Changes to Terms of Use
GrowthFoundation.in retains the right to change these Terms of Use at any time in its sole and absolute discretion, with or without notice to you. The most current version of these Terms of Use, which will supersede all previous versions, can be reviewed on its website GrowthFoundation.in. Continued use of GrowthFoundation.in website or its Service after changes are made, means acceptance of such changes.
